NOTICE OF VIOLATION
1. On December 10, 2003, agents of the FCC's San Juan
Office responding to a complaint of interference to the broadcast
STL frequency of 942.5000 MHz, observed spurious radio
transmissions from SkyTel's 940.20-940.25 MHz transmitter located
in Crown Castle's facilities (Tower ID - 1059383) in Bayamon, PR
. The following violation(s) were observed:
1.a. 47 C.F.R. � 24.131: The authorized bandwidth of
narrowband PCS channels will be 10 KHz for 12.5 kHz
channels and 45 kHz for 50 KHz channels. At the time of
the investigation, 12:30 PM AST, the bandwidth of
SkyTel's transmitter exceeded this limit causing harmful
interference.
2. Pursuant to Section 1.89 of the Commission's Rules, 47
C.F.R. � 1.89, you must submit a written response to this Notice
to the address in the letterhead by January 5, 2003. Include a
statement of the specific action(s) taken to correct and preclude
recurrence of each violation. If you have not completed all
corrective actions by the time your reply is due, provide the
date you will complete each action. Mark all replies and
documentation with the file number specified above.
3. Failure to respond to this Notice constitutes a separate
violation that could result in additional penalties, including
monetary forfeiture. Any statement or information you provide
may be used by the Commission to determine if further enforcement
action is required.
