Auction No. 25 included 118 construction permits. All spectrum was the subject of pending, mutually exclusive applications for construction permits for the AM, FM, TV, LPTV, and FM and television translator services, for which the Commission had not approved a settlement agreement and participation in this auction was limited to those applicants.

Initially the inventory for this auction was 237 construction permits. Due to the filing of settlement proposals which resolved the mutual exclusivity issue, several MX groups (4 AM, 43 FM, 4 FMT, 15 PST, and 52 SST) were removed from the auction. (See Public Notices DA 99-1346 and DA 99-1949) One other FM construction permit for Pahrump, Nevada was removed and auctioned separately under Auction No. 27. (See Public Notice DA 99-2062)

AM Broadcast (AM): A broadcast station licensed for the dissemination of radio communications intended to be received by the public and operated on a channel in the AM broadcast band.

FM Broadcast (FM): A station employing frequency modulation in the FM broadcast band and licensed primarily for the transmission of radio telephone emissions intended to be received by the general public.

FM Translator (FMT): A station in the broadcast service operated for the purpose of retransmitting the signals of an FM radio broadcast station or another FM broadcast translator station without significantly altering any characteristics of the incoming signal other than its frequency and amplitude, in order to provide FM broadcast service to the general public.

TV Broadcast (PST): A station in the television broadcast band transmitting simultaneous visual and aural signals intended to be received by the general public.

LPTV (SST): A station that may retransmit the programs and signals of a TV broadcast station and that may originate programming in any amount greater than 30 seconds per hour and/or operates a subscription service.

TV Translator (SST): A station in the broadcast service operated for the purpose of retransmitting the programs and signals of a television broadcast station, without significantly altering any characteristic of the original signal other than its frequency and amplitude, for the purpose of providing television reception to the general public.

In the "Closed" Broadcast Auction, the bidding credit depends upon the number of ownership interests in other media of mass communications that are attributable to the bidder-entity and its attributable interest-holders. (See PN DA99-1346 for more information)

  • A 35 percent bidding credit will be given to a winning bidder if it, and/or any individual or entity with an attributable interest in the winning bidder has no attributable interest in any other media of mass communications, as defined in 47 C.F.R. § 73.5008; and,
  • A 25 percent bidding credit will be given to a winning bidder if it, and/or any individual or entity with an attributable interest in the winning bidder has an attributable interests in no more than three media of mass communications, as defined in 47 C.F.R. § 73.5008; and,
  • No bidding credit will be given if any of the commonly owned mass media facilities would serve the same area as the proposed broadcast or secondary broadcast station, as defined in 47 C.F.R. § 73.5007, or if the winning bidder, and/or any individual or entity with an attributable interest in the winning bidder, have attributable interests in more than three mass media facilities.

However, attributable interests held by a winning bidder in existing low power television, television translator or FM translator facilities will not be counted among the bidders' other mass media facilities.

Licenses are issued for an eight year term.
