Licenses Offered

Auction No. 39 offered a total of 2,450 licenses. 14 licenses consisting of paired 50 MHz channel blocks were offered in each of the 172 Economic Areas (EAs) and 3 EA like areas, covering the U.S. territories in Guam and the Northern Mariana Islands, Puerto Rico and the United States Virgin Islands, and American Samoa

Channeling Plan

Separated by spacing of 700 MHz between transmit and receive frequencies
Licensees may subdivide channels as desired

Permissible Operations

39 GHz licensees may provide fixed communications including point-to-point and point-to-multipoint communications. Mobile communications are subject to the development of inter-licensee and inter-service interference criteria. See Report and Order and Second Notice of Proposed Rule Making at para. 25.

License Period

Licenses are issued for a ten-year term from the initial license grant date. Licensees have a renewal expectancy based on the provision of substantial service and substantial compliance with applicable Commission rules, policies, and the Communications Act. (See 47 C.F.R. § 101.13 (d)).

Performance Requirements

Demonstration of substantial service required for both incumbent and new licensees (See 101.17 of the Commission's Rules).

Incumbents

There are incumbent licensees present in the 39 GHz band.

Bidding Credits

Bidding credits are available to small and very small businesses (or consortia of small or very small businesses) as are set forth in 47 C.F.R. § 101.1209 . A bidding credit represents the amount by which a bidder’s winning bids are discounted. The size of the bidding credit depends on the average gross revenues for the preceding three years of the bidder and its controlling interests and affiliates:

A bidder with average gross revenues of not more than $40 million for the preceding three years receives a 25 percent discount on its winning bids for a 39 GHz band licenses ("small business")

A bidder with average gross revenues of not more than $15 million for the preceding three years receives a 35 percent discount on its winning bids for a 39 GHz band license ("very small business").

Bidding credits are not cumulative. A qualifying applicant receives either the 25 percent or 35 percent bidding credit, but not both.
