Retrospective Regulatory Review

Section 610 (a) of the Regulatory Flexibility Act (RFA) (5 U.S.C. 601 et seq.) requires that federal agencies review rules that may have a significant economic impact on a substantial number of small entities within ten years of publication of the final rule.

Annually, OCBO publishes a Public Notice seeking comment on FCC rules that are under Section 610 review in order to determine whether such rules should be continued without change, amended, or rescinded, consistent with the stated objectives of applicable statutes, to minimize any significant economic impact of the rules on small entities.

The FCC’s most recent Public Notice announcing the FCC’s annual Section 610 Retrospective Review can be found here.  The notice is also published in the Federal Register and available at www.federalregister.gov

Semi-Annual Regulatory Flexibility Agenda

Section 610(c) of the Regulatory Flexibility Act (RFA) (5 U.S.C. 601 et seq.) requires that agencies publish semiannual regulatory flexibility agendas in the Federal Register identifying those rules that may have a significant economic impact on a substantial number of small entities.  OCBO assists the FCC in meeting that requirement by coordinating the Commission’s Spring and Fall submissions for the Unified Agenda.  The FCC’s current Regulatory Agenda can be found at www.reginfo.gov.
