Section 301 of the Communications Act of 1934, as amended (the Act) prohibits the use or operation of a radio frequency station except in accordance with a Commission-granted authorization. Investigations focus on operating without a Commission license or other authority or in a manner inconsistent with the Communications Act, Commission rules, and terms of the underlying authorization/license, including stations in the services listed below. Such investigations check that broadcasters and other wireless licensees operate in accordance with the technical terms of their licenses, including type of antenna, power levels, and hours of operation, among others. In addition, broadcasters must have required EAS equipment and comply with EAS operational and recordkeeping rules. The Commission’s rules contain construction and discontinuance of service requirements that promote productive use of spectrum, encourage provision of service to customers in a timely manner, and promote the provision of innovative services. EB is responsible for investigating licensee failures to comply with construction and/or discontinuance rules that may undermine these important goals.
